Terms of Service

These Terms apply to the website grainofsandrealty.us and to services provided by Grain of Sand Realty, Inc., 16650 SW 88th St, Suite 108, Miami, FL 33196. Brokerage services are governed by the written agreement you sign with us (buyer, listing, leasing, or management agreement), which controls if it differs from these Terms.

1. Written agreements

We provide representation only under a signed written agreement that describes the services, how we are compensated, and the agreement's duration. Compensation is negotiable and is not set by law.

2. Website information

• Property information on or linked from this site comes from sources believed reliable but is not guaranteed. Verify all details — square footage, schools, taxes, flood zone, and HOA rules — independently.
• The Buyer Toolkit produces estimates only. It is not a loan offer, appraisal, or financial advice.
• Transaction summaries on our Closed Deals page are illustrative and omit identifying details.

3. What we don't provide

We are not attorneys, tax advisors, home inspectors, mortgage lenders, or insurance agents. We encourage you to consult qualified professionals for legal, tax, inspection, financing, and insurance questions.

4. Fair housing

We follow federal, Florida, and Miami-Dade County fair housing laws and do not discriminate on the basis of race, color, religion, sex, national origin, disability, familial status, or any other protected characteristic.

5. Escrow and funds

Deposits held by our brokerage are kept in escrow or trust accounts as Florida law requires. Disputes over escrowed funds are handled under the procedures set by Florida law and your contract.

6. Wire fraud

We will never send wiring instructions by email. Always confirm instructions by phone with the closing agent using a number you have verified independently. We are not responsible for losses from fraudulent instructions you did not verify.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages arising from use of this website or its tools. Nothing here limits obligations we owe you under Florida law or your signed agreement.

8. Complaints and dispute resolution

Contact support@grainofsandrealty.us or (305) 382-6274. Complaints go to the broker; we acknowledge them within one business day and provide a written response within ten business days. If we cannot resolve a dispute informally, both parties agree to try good-faith mediation in Miami-Dade County, Florida, with mediator costs shared equally, before filing suit, unless your signed agreement provides a different process. Either party may bring an eligible claim in small claims court.

9. Governing law

These Terms are governed by the laws of the State of Florida.
